By accessing or using Thumbfast ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Thumbfast is an AI-powered thumbnail generation platform that allows users to create, edit, and manage thumbnails for video content. The Service includes thumbnail generation, template selection, avatar creation, image editing, and related features accessible through our website and API.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years of age to use the Service.
  • One person or entity may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Subscriptions and Payment

  • Paid plans are billed in advance on a monthly or yearly basis depending on the plan selected.
  • Prices are subject to change with reasonable notice. Active subscriptions will not be affected until the next renewal.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • Free tier usage is subject to the limits described on our pricing page. We reserve the right to modify free tier limits.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Create thumbnails that infringe on the intellectual property rights of others.
  • Generate misleading or deceptive content designed to manipulate viewers.
  • Attempt to circumvent usage limits, access controls, or security measures.
  • Use automated tools to access the Service beyond the intended API.
  • Resell, redistribute, or sublicense access to the Service without authorization.

6. Content and Intellectual Property

  • Your content — you retain ownership of images, videos, and text you upload to the Service. By uploading, you grant us a limited license to process this content for the purpose of providing the Service.
  • Generated thumbnails — thumbnails created through the Service are yours to use for personal and commercial purposes, subject to these terms and any applicable third-party licenses.
  • Our platform — the Thumbfast platform, including its design, code, templates, and branding, remains our intellectual property.
  • Feedback — any suggestions or feedback you provide may be used by us without obligation to you.

7. AI-Generated Content Disclaimer

Thumbnails are generated using third-party AI models. While we strive for quality results, we do not guarantee that generated content will be free from errors, inaccuracies, or unintended elements. You are responsible for reviewing all generated thumbnails before use. We are not liable for any claims arising from your use of AI-generated content.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Thumbfast and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms or engage in activity that is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation before pursuing formal proceedings.
